These terms cover your use of heathotsauce.com and any purchase you make from Heat, doing business as Heat Hot Sauce Shop ("we", "us"). By using the site or placing an order, you agree to them. If you don't agree, please don't use the site. Our Privacy Policy, Shipping Policy, Refund Policy and Subscription Policy are part of these terms.

Who we are

Heat Hot Sauce Shop has sold specialty hot sauce online since 2012. We're based in San Leandro, California. Our store runs on Shopify.

Using the site

You must be at least 18, or the age of majority where you live, to place an order. Younger visitors may use the site only with a parent or guardian. Please don't misuse the site: no attempts to break or overload it, scrape it in bulk, get into other people's accounts, place fraudulent orders, or use it for anything illegal.

Your account

You can sign in at account.heathotsauce.com with a one-time code sent to your email. Keep access to your email secure, because anyone who can read it can sign in to your account. You're responsible for activity on your account. Tell us right away if you think someone else has used it.

Products and listings

We work hard to describe products accurately, but we're a curator, not the maker, of most of what we sell. Sauce makers sometimes change recipes, labels, bottle sizes or heat levels without telling us, and colors on your screen may not match the real thing. The label on the product you receive is the final word on ingredients and allergens. Always read it before eating. Heat ratings, tasting notes and descriptions on our site are our honest opinions and estimates, and everyone experiences heat differently.

Extreme heat products

Some of our sauces, extracts and seasonings are extremely hot. Please use them with care:

• Start with a small amount, especially with sauces labeled as extra hot or made with extracts.
• Keep them away from children and pets.
• Avoid contact with your eyes and other sensitive areas, and wash your hands after handling. Consider gloves when handling the hottest products.
• If you have a medical condition, a sensitive stomach, food allergies, or are pregnant, check the ingredients and talk to your doctor before eating very spicy food.

Our products are meant to be enjoyed as food. They are not intended for eating challenges or stunts that put anyone's health at risk, and you use them at your own risk.

Prices and availability

Prices are in US dollars and can change at any time. Shipping and any sales tax are added at checkout. Products can sell out or be discontinued, and we may limit quantities. If a product is listed at the wrong price or by mistake, we may cancel orders for it, even after you've received an order confirmation. If we've already charged you, we'll refund you in full.

Orders

Your order confirmation email means we've received your order, not that we've accepted it. We may refuse or cancel an order, for example if an item is out of stock, there's a pricing error, or the order looks fraudulent. If we cancel an order you've paid for, we'll refund you in full. To cancel or change an order yourself, contact us quickly; once it ships, it can't be canceled. See our Refund Policy.

Payment

We accept credit and debit cards, Shop Pay, PayPal, Apple Pay, Google Pay, Amazon Pay, and other options shown at checkout. Payments are processed by those providers through Shopify's checkout; we don't store your full card number. By placing an order, you confirm you're allowed to use the payment method you choose.

Personal use

Products are sold for personal use, including gifts. Please don't buy them for resale. If you're interested in wholesale or corporate gifts, contact us.

Shipping and returns

How and when we ship is covered in our Shipping Policy. Because our products are food, we don't accept returns, but we make it right when something arrives broken or defective. See our Refund Policy.

Hot Sauce of the Month Club

The Hot Sauce of the Month Club is a subscription. Your plan, how it renews, and how to change or cancel it are set out in our Subscription Policy, which is part of these terms. In brief:

• Club boxes ship on the 1st of each month. Renewals are billed to your saved payment method on the 23rd of the month before.
• Auto-renewing plans keep renewing until you cancel. Plans marked "One-time order" are charged once and never renew.
• You can skip, change or cancel at account.heathotsauce.com, or by chat or email. To avoid the next charge, cancel before the 23rd.
• We choose the sauces in each box. If you tell us your heat preference and any dietary needs or allergies, we'll do our best to follow them, but sauces are made by many different makers and we can't guarantee that any box is free of a particular allergen. Always read the label.

Gift cards

Gift cards can be used for purchases on heathotsauce.com. They don't expire and can't be refunded or exchanged for cash, except where the law requires it. In California, for example, you can ask for a cash refund of a remaining balance under $10. Treat a gift card like cash: we can't replace one that's lost or used by someone else without your permission.

Discounts and promotions

Discount codes and promotions follow the terms shown with them. They have no cash value, may end at any time, and can't be applied to past orders. We may cancel orders that misuse a code.

Reviews and other content you share

When you post a review, photo or other content on our site, you're confirming it's your own honest opinion and that you have the right to share it. You give us permission to display, copy and share it on our site, in emails and in our marketing, with your name as shown in the review. Please don't post anything false, offensive, illegal, or that includes someone else's personal information. We may remove content that breaks these rules. We don't pay for positive reviews or hide negative ones because they're negative. If you send us ideas or feedback, we're free to use them without owing you anything.

Our content and other brands

The text, photos, graphics and design of our site belong to us or to the people who licensed them to us. Please don't copy them for commercial use without permission. Brand names, logos and labels of the sauces we sell belong to their makers.

Other websites and services

Our site links to other websites and uses outside services, such as payment providers and shipping carriers. We're not responsible for their content or how they operate. Their own terms and privacy policies apply.

Disclaimer

We provide the site and our products as they are, without promises beyond those in these terms and our policies. We don't promise the site will always be available or error-free. Nothing in these terms takes away rights you have by law that can't be waived, including any warranties the law gives you on the products you buy.

Limitation of liability

To the extent the law allows, we're not liable for indirect, incidental or consequential damages, such as lost profits or data, arising from your use of the site or our products. Our total liability for any claim about an order is limited to the amount you paid for that order. Some places don't allow these limits, so they may not apply to you.

Indemnity

If someone makes a claim against us because you broke these terms, misused our products, or posted content that wasn't yours to post, you agree to cover our reasonable costs of dealing with it, including legal fees.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Alameda County, California, and you and we agree to those courts' jurisdiction. Either of us may still bring a qualifying claim in small claims court.

Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top shows when they last changed. Changes apply to orders placed after they're posted. If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't given up the right to enforce it later.
